  1. GENERAL ISSUES

1.1. SIA LABRAINS (Latvia), unified registration no. 40203171808, address: Latgales iela 127A, Riga, LV-1037, Latvia, e-mail: info@labrains.eu, (hereinafter - LABRAINS), on its website www.labrains.lv there is an e-store - a remote purchasing system website ( hereinafter - E-store), which provides an opportunity to familiarize yourself with LABRAINS products and place an order.

1.2. Every person (hereinafter - the Customer), placing an order in the E-shop (hereinafter - the Order), confirms that he has read and undertakes to comply with these rules, including the information about delivery, delivery fees and types, delivery times. The customer - consumer, when placing the Order, also confirms that he has received information about the right of withdrawal, the conditions of their use, terms and procedures, which are an integral part of these regulations.

1.3. Delivery of LABRAINS products available in the e-store is provided by the order delivery cooperation partners.

1.4. By choosing the communication settings, the Customer chooses whether to receive notifications and useful LABRAINS offers. The Customer can choose the communication channels through which LABRAINS provides notifications and offers to the Customer. If the Customer chooses to receive notifications and offers from LABRAINS, the Customer agrees that LABRAINS can send them using the communication channel chosen by the Customer. The customer can opt out of receiving notifications and LABRAINS offers by sending an e-mail to info@labrains.eu.

 

  1. ORDER PLACEMENT AND RECEIPT

2.1. When placing an Order in the E-store, the Customer confirms that he is familiar with the description of the selected cosmetic products (hereinafter referred to as the Product) and that it meets the requirements and needs of the Customer.

2.2. At the time of placing the Order, the Customer undertakes to provide the exact personal data necessary for the provision and execution of the Order, the delivery address and contact information of the Order. In case of inaccurate data, the Order is not provided.

2.3. The customer agrees to the processing of his personal data, including personal identification codes, and the use of technological solutions in order to ensure the fulfillment of the Order, administration of payments, offering of goods, handling of claims in accordance with the laws and regulations.

2.4. In the e-store environment, information about the orders placed is not stored permanently. All documentation related to the Order is kept by the Customer independently.

2.5. After the Customer has placed the Order and confirmed that he has familiarized himself with these terms and other binding documents, a confirmation of the receipt of the Order application is automatically sent to the e-mail specified in the Customer's application, which is of an informational nature only.

2.6. If the Goods specified in the Order are available and the Order can be fulfilled, within 1 (one) working day from the moment of receipt of the Order application, the Customer is informed (by e-mail or by telephone) about the availability of the Order and delivery terms.

2.7. Delivery of the order is ensured within 1-7 (one to seven) working days after the confirmation of the Order and receipt of payment for the Order from the Customer. However, LABRAINS reserves the right to deliver the Order within 2 (two) calendar weeks, as delivery terms may change depending on the availability of the Product in the warehouse.

2.8. At the time of delivery of the order, the Customer undertakes to be at the specified location and present an identity document, otherwise the Order will not be issued. The Order is not issued to another person.

2.9. If the Order is not placed because the Customer cannot be found at the specified address, the Order is re-delivered after the Customer re-commits to be at the specified place and time. An additional delivery fee may be charged for repeat delivery of the Order.

2.10. At the time of order delivery, the Customer is obliged to accept the Order and check its compliance and quality, as well as to sign the documents related to the execution of the relevant Order.

2.11. Delivery of orders can also be performed using other delivery methods upon agreement. You can get acquainted with the terms of delivery of goods, which are not stipulated in these terms and conditions, here.

2.12. The delivery note for the Goods is sent to the e-mail address specified in the Order, as well as information on the procedure for exercising the Customer's - consumer's right of refusal. The delivery note, as a document confirming the purchase, is prepared and approved electronically and is sent to the Customer at the time of delivery of the Order.

 

  1. ORDERING AND PAYMENT FOR FOOD

3.1. By placing an Order in the E-store, the Customer agrees to the price of the selected Product and its payment procedure.

3.2. Product prices in the E-shop are indicated in EURO with taxes, including value added tax. The fee for the delivery of the Order (if provided for) is determined separately, according to the chosen delivery method and delivery address, according to the E-store delivery price list.

3.3. The Customer can pay for the Order:

3.3.1. at the time of placing the order in the E-shop,  using internet banking "bank-link" services;

3.3.2. using MASTERCARD and VISA payment cards;

3.3.3. by transfer to the bank account specified in the invoice within 2 working days after receipt of the invoice;

3.3.4. in cash, at the time of receipt of the goods at the office of SIA LABRAINS, address: Latgales iela 127A, Riga, LV-1037 

  1. PRAYERS, THE QUALITY

4.1. The goods are non-food and non-edible cosmetic products.

4.2. LABRAINS has designed all the Products that can be purchased in the E-shop. The Products developed by LABRAINS consist of natural ingredients and are cosmetic products that are safe for human life, health, and the environment. All Products comply with the norms of the Law of the Republic of Latvia "Goods and Services Safety Law", as well as international regulatory enactments.

  1. RIGHT OF REFUSAL

5.1. If the Customer - consumer wants to use the right of refusal, the following recommendations and conditions should be taken into account:

5.1.1. The product that the Customer wants to return must not be used (taking into account the specifics of the Product). If the condition of the Product has deteriorated, and this has happened due to improper storage, the Customer does not have the right to exercise the right of withdrawal.

5.1.2. The Customer is obliged to keep and not damage the original packaging of the Product.

5.1.3. If the Customer wishes to exercise the right of withdrawal, in that case he must contact LABRAINS by e-mail: info@labrains.eu. The customer receives from LABRAINS a cancellation form, which is filled out and sent by LABRAINS to the aforementioned e-mail.

5.1.4. The Customer is obliged to keep both courier documents for receiving the Product and postal/courier documents for returning the Product to the Seller.

5.2. The Customer can find detailed information about what a distance contract is and the right of withdrawal at the following website address: http://www.ptac.gov.lv

5.3. Money for the returned Product is transferred by LABRAINS to the bank account specified by the Customer in the cancellation form within 14 (fourteen) calendar days after the termination of the distance contract and receipt of the Product specified in the cancellation form at the LABRAINS warehouse (Latgales Street 127, Riga).

5.4. The customer bears the costs associated with returning the Product.

 

  1. FINAL PROVISIONS AND DISPUTE RESOLUTION

6.1. LABRAINS has the right to make changes to these terms at any time without prior agreement with the Customer.

6.2. These rules are prepared in accordance with and regulated by the laws and regulations of the Republic of Latvia, and all disputes are subject to the courts of the Republic of Latvia.

6.3. The Customer's personal data will be used to identify the Customer and receive the Order, carry out the Order and its delivery, prepare accounting documents, including the invoice, refund the overpaid amount and return the amount for returned products, administer financial obligations and other obligations arising from these Terms of Use .
