 Labrains SIA (hereinafter - "LABRAINS") is important for the trust of our customers. Our goal is to make our Customers feel safe when they share their personal data with us. In our daily activities, we take care that personal data is protected. LABRAINS takes care of its customers' privacy and personal data protection, respects the customers' right to the legality of personal data processing in accordance with Regulation 2016/679 of the European Parliament and the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data ( hereinafter referred to as the Regulation) and other laws and regulations in force in the Republic of Latvia, binding instructions and regulations issued by the responsible institutions in the field of privacy and data processing.

This Privacy Policy informs and provides an explanation of how LABRAINS takes care of and protects the personal data of the Clients in its possession, explains in what way and for what purposes the data of our Clients is processed, as well as provides information about the rights and obligations of our Clients.

We have made the privacy policy as simple as possible, but please familiarize yourself with the following concepts first:

  • data subject: a natural person who can be directly or indirectly identified;
  • personal data: any information directly or indirectly attributable to a natural person;
  • services: any kind of services and goods that LABRAINS offers and provides online or in person;
  • processing of personal data: any actions performed with personal data, including collection, registration, input, storage, use, transfer, blocking or deletion of data.
  • controller: a natural or legal person, state or local government institution, which alone or together with others determines the purposes and means of processing personal data, as well as is responsible for the processing of personal data in accordance with the Personal Data Protection Law.

1. General rules

The purpose of this privacy policy is to inform and provide an explanation of how LABRAINS takes care of and protects personal data that comes into its possession, that is, to help understand in what way and for what purposes personal data is processed, as well as to introduce the rights of data subjects.

When processing personal data, LABRAINS complies with Regulation 2016/679 of the European Parliament and of the Council (April 27, 2016) on the protection of natural persons with regard to the processing of personal data and the free movement of such data and which repeals Directive 95/46/EC (General Data protection regulation), the Law on the Processing of Personal Data, other applicable laws in the field of privacy and data processing, as well as this privacy policy. In the event that the data processing obligation results from specific industry legislation, we process your personal data in accordance with the procedures set out in these legislation.

The privacy policy applies to every data subject whose personal data is processed by LABRAINS. With regard to issues affecting employment legal relations, we have developed separately binding information, which the employee will be able to familiarize himself with when starting employment legal relations. 

The privacy policy does not apply to data processing by other merchants, including if you visit another merchant's website or use its service, accessing them through the LABRAINS website. In such cases, we invite you to familiarize yourself with the personal data security guarantees provided by the relevant merchant.

Any submitted, collected and received personal data will be processed only for the stated purpose and only to the extent necessary to achieve the purpose. Information will be provided about the specific data to be transferred and, if necessary, your consent will be requested in accordance with the General Data Protection Regulation and other documents regulating data processing.

3. Legal basis for data processing

We process your personal data only if one of the following grounds exists:

  • obtained your consent;
  • for the realization of our legal (legitimate) interests;
  • for the conclusion or performance of a contract;
  • for the fulfillment of obligations provided for by law.

We have taken the necessary technical and organizational measures to ensure the security of personal data, which ensures the protection of your personal data from accidental disclosure, change or other illegal data processing.

4. Data processing purposes

In order to collect and scientifically evaluate information on the manifestations of cosmetic side effects experienced by the client when using cosmetic products and to consider options to reduce the risk, carry out prevention and, if necessary, regulatory actions in relation to the cosmetic product, as well as to demonstrate that the cosmetic product complies with In accordance with the requirements of Regulation 1223/2009, in order to perform a safety assessment (Article 10), which must be regularly updated, we process the personal data submitted by the customer (name, surname, date of birth, weight, gender, contact phone number, e-mail, and health data). Please note that in connection with the purpose of this data processing, we may also obtain your personal data from third parties, namely from medical practitioners and pharmacists. We only process the data submitted to us for this purpose and strictly adhere to confidentiality and personal data protection. The legal basis for data processing is Article 6, Part One, Subpoint (c) of the General Data Protection Regulation.

In order to collect and scientifically evaluate information on the manifestations of side effects of the cosmetic product, which the customer experienced when using cosmetic products, in order to consider the possibilities of how to reduce the risk, carry out prevention and, if necessary, regulatory actions regarding cosmetic products, we process the personal data of such medical personnel, pharmacist , who submitted a report to us. In this case, we process the name, surname, specialty, certificate number, workplace address, contact information and submitted patient information of medical personnel and pharmacists.

For the purpose of entering into, performing or terminating the contract, we may process the personal data of the partner or its employees (for example, name, surname, contact information, position, payment account number, as well as other personal data submitted to us). The processing of personal data can also take place within the scope of the consulting services of the partner, if it is related to the purpose of the contract. Prior to the conclusion of the contract (at the stage of initiation of the contract), personal data may be processed to prepare quotations or purchase orders or to fulfill other possible customer requests related to the conclusion of the contract. In the process of preparing the contract, we may contact potential customers, partners or their employees using the information they provide.

In order to provide answers to the questions of customers or partners, directly by telephone or electronic communication with our staff, we process your voluntarily provided personal data - name, surname, phone number and e-mail address, as well as other information provided. Your personal data will only be used to contact you and answer your questions, comments or suggestions.

When applying for our advertised vacancies, we will process your data only to ensure the recruitment process for the position you have applied for. If data processing will take place for other purposes, for example, to inform you about, in our opinion, other suitable vacancies for you, we will inform you before the start of processing and ask for your consent. If the candidate has provided a reviewer, we will also process their contact details so that the feedback provided can be evaluated in the selection process. During the candidate selection process, we may also obtain and process information from recruitment companies.

In order to exercise and/or protect our rights or the rights of third parties in relation to the holders of these rights, consultants and institutions, we can process your personal data available to us (name, surname, contact information, other personal data that needs to be processed to achieve this purpose).

We can process your personal data in order to comply with applicable legal acts of LABRAINS, such as laws applicable to pharmacy, accounting, taxes, fees, etc., Civil Code, Commercial Law, Law on Taxes and Fees, Law on Accounting, and other regulatory acts.

In order to send offers based on your interests, to which you have given your consent, we process your first name, last name, e-mail address, telephone number and position. We would like to inform you that consent is not the only basis for us to send you offers. The second part of Article 9 of the Law on Information Society Services also provides for cases where commercial communications can be sent without obtaining consent, for example, if the e-mail address was obtained as part of a previously conducted transaction.

 6. Data retention period

We will store your personal data for as long as is necessary to achieve the stated processing goals, unless longer storage is determined or permitted by applicable laws and regulations. If the data is processed based on your consent, then the data will be processed as long as your consent is valid and has not been withdrawn.

We may share your personal data within the company group, subject to sufficient and appropriate protection of your data.

In order to fulfill the obligations set out in the regulatory acts, for example, if we become aware of possible negative reactions regarding one of our products, then in accordance with the requirements of the law, we are obliged to document and provide the relevant information, including personal information, to authorities around the world, as well as, where necessary for additional evaluation, contact the report submitters.

We always ensure adequate protection and confidentiality when transferring or receiving your personal data and the data is processed only in accordance with the purposes specified by us.

8. External data processing service providers

We use service providers who support us in the performance of the services we provide. These service providers process your data on our behalf, in accordance with our instructions and under our supervision only for the purposes described in this privacy policy. We will take all necessary measures to guarantee adequate protection of the data you provide in accordance with the requirements of applicable data protection laws.

Payment processing is being provided by payment platform makecommerce.lv, therefore our company provides personal data required for payment processing to the platform owner Maksekeskus AS.

Your personal data is basically processed in the territory of the European Union and the European Economic Area (EU/EEA).

In such cases, LABRAINS chooses to use special personal data protection measures to ensure the security of personal data. For example, if your personal data is transferred to countries outside the EU/EEA, LABRAINS guarantees an adequate level of protection using available transmission tools, such as the EU decision on the adequacy of the level of protection, standard contract clauses, binding company rules, derogations or other tools and/or additional the measures applied in the case of a particular shipment.

You have the right to familiarize yourself with or obtain information about the transfer of your personal data outside the EU/EEA by writing us an e-mail or writing a submission to LABRAINS.

11. Your rights regarding the processing of personal data

In accordance with the General Data Protection Regulation and the legislation of the Republic of Latvia, you have the right to:

  1.  access your personal data and receive information about their processing;
  2.  request correction of incorrect, inaccurate or incomplete personal data, or correct them yourself by logging in to your profile;
  3.  delete your personal data ("be forgotten"), except in cases where the law requires us to retain the data;
  4.  withdraw previously given consent to data processing;
  5.  restrict the processing of your data - the right to request that we temporarily stop processing all your personal data;
  6.  request a copy of your personal data in electronic format and the right to transfer this data to another controller (data portability);
  7.  contact the Data State Inspectorate.
